The POD Collective Tenancy Policy

The company has a clearly defined tenant agreement that is existing with the current tenants. The agreements can vary from tenant to tenant slightly depending on the master agreement that company has with the house owners.

Payments and Security Deposits

1. The tenants will have to pay an interest free security deposit equivalent to 2 months of the agreed house rent that has been agreed with the company (The Pod Collective) during the execution of the agreement

2. The house rent has to be paid by the tenants in advance within the agreed timelines defined in their respective contracts/ agreements

3. Upon completion of the Agreement, the security deposit shall be refunded by the Company to the tenants after adjusting for the due and complete performance, observance and compliance by the tenants for all the terms and conditions contained in their respective agreements with the company.

Representation AND Covenants of the Tenant

a.) The tenant shall use the house exclusively for residential purposes permitted under applicable laws and for the purpose as agreed to between the Parties, and with due care and caution, subject to normal wear and tear arising in normal course of business.

b.) The tenant shall not do or cause or permit to be done upon the house anything, which may create or cause harm or damage to the house, subject to normal wear and tear arising in the normal course of stay.

c.) The tenant shall fully vacate the house and restore the house to good condition at the time of handover of the house by the tenant to the company on the date of termination or expiry of the Term of this Agreement, whichever is earlier, subject to, normal wear and tear.

d.) The tenant shall ensure that all the furniture and electrical appliances that were provided by the company to the tenant during the time of the agreement are handed over to the company in good and working condition, during the time of vacating the house.

Termination and Expiry

In case the tenant desires to terminate this Agreement, then the tenant shall inform the company by serving a written notice for termination [1[one] month] in advance and shall continue to pay the Fees till the due date of vacation of the house without damaging the house or any of the furniture and electrical appliances that were provided by the company, subject to reasonable wear and tear.

The company may terminate this Agreement either for (a) convenience, with an advance written notice of [1 (one) month] or for (b) cause, with immediate effect upon written notice to the tenant, if the tenant is in violation of or has not otherwise performed or complied with any terms of this Agreement, in whole or in part, or is in violation of the applicable laws.

Miscellaneous

Damages:
In case, the tenant overstays beyond the due date of the termination or after the expiry of the Term, the tenant shall pay liquidated damages of [8% of monthly rental amount] per day of overstay beyond the Term in addition to Fees and other charges payable in terms hereof, which is agreed and acknowledged by the company

Inspection and Viewing:
The company has the right to enter upon the rented premises i.e., the House, having given reasonable notice to the tenants (except in case of an emergency when no notice is required), along with his representatives, workers, contractors, agents or professional advisors to inspect and view the state and condition

Security and Safety:
a.) In order to maintain a peaceful environment of the society, nuisance or misconduct of any kind including but not limited to playing loud music beyond the permitted time limit, drinking/smoking in society corridors/ premises and consumption of illegal and banned substances are not allowed in The POD Collective houses.

b.) Internal issues/ fights among the tenants are better resolved among roomies. Involvement of The POD Collective is not beneficial and hence undesirable.

c.) In the event a tenant breaks any laws of the land or rules as stipulated in their agreement, The company reserves the right to, issue appropriate notice including but not limited to Eviction notice to the tenant or charge a penalty amount of 10000 INR or more at its sole discretion.

Pet Policy:
The POD Collective is a pet friendly company, however the pet policies would vary from property to property and the tenants should get in touch with their respective property managers for further information
